Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your use of the Mind & Bump mobile application and website (collectively, the “Service”), operated by Assert Equals Ltd, a company registered in England and Wales (company number 12145602), with its registered office at 128 City Road, London, United Kingdom, EC1V 2NX (“we”, “us”, or “our”).

By downloading, installing, or using Mind & Bump, you agree to be bound by these Terms. If you do not agree, please do not use the Service. These Terms form a legally binding agreement between you and Assert Equals Ltd.

2. Eligibility

You must be at least 13 years old to use Mind & Bump. By using the Service, you confirm that you meet this age requirement. If you are under 18, you confirm that you have obtained the consent of a parent or legal guardian. We do not knowingly allow use of the Service by anyone under 13.

3. Description of Service

Mind & Bump provides daily affirmation cards tailored to pregnancy trimesters and the postpartum period, along with optional audio narration, daily notification reminders, a home screen widget, and a favourites archive. The Service is available on iOS and Android. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

4. Account Registration

To access certain features, you may create an account using your email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to notify us promptly of any unauthorised use of your account.

5. Free Trial & Subscriptions

Certain premium features — including audio narration — are available free for a 7-day trial period beginning from the date you first use the app. After the trial period, continued access to premium features requires a paid subscription.

Subscriptions are purchased through the Apple App Store or Google Play Store and are subject to their respective terms. Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage and cancel your subscription in your device's account settings.

Refunds are governed by Apple's and Google's respective refund policies. We do not process refunds directly.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Attempt to reverse-engineer, decompile, or extract the source code of the app
• Access or attempt to access another user's account
• Use the Service in any way that could damage, disable, or impair it
• Reproduce, distribute, or commercially exploit any content from the Service without our written permission
• Use automated tools to access or scrape the Service

The Service is intended for personal, non-commercial use only.

7. Intellectual Property

All content within Mind & Bump — including affirmation text, audio, design, graphics, source code, and the Mind & Bump name and logo — is owned by or licensed to Assert Equals Ltd and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use. This licence does not include any right to reproduce, modify, distribute, sell, or create derivative works from any content in the Service.

8. Health Disclaimer

Mind & Bump is a wellness application designed to provide emotional support and positive affirmations during pregnancy and the postpartum period. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Nothing in the Service should be interpreted as professional medical guidance.

Always consult a qualified healthcare provider for any questions or concerns relating to your pregnancy, health, or the health of your baby. If you are experiencing a medical emergency, contact the emergency services immediately.

9. Third-Party Services

The Service integrates third-party providers including Clerk, RevenueCat, ElevenLabs, PostHog, and Sentry. Your use of these services is subject to their own terms and privacy policies. We are not responsible for the practices or content of any third-party service.

10. Disclaimers & Warranty

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We reserve the right to perform maintenance or updates that may temporarily affect availability.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Assert Equals Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or £10, whichever is greater.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify and hold harmless Assert Equals Ltd, its directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any applicable law or third-party rights.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if required by law. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) shall remain in effect.

14. Governing Law & Jurisdiction

These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter.

15. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from these Terms. The remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Assert Equals Ltd with respect to the Service and supersede all prior agreements, understandings, and representations.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or an in-app notice before the changes take effect. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
